Legal framework

The primary framework is Law No. 1 of 1970 on Occupational Safety, reinforced by Government Regulation No. 50 of 2012 on the Occupational Safety and Health Management System (SMK3). Companies with 100 or more employees, or those in high-risk sectors, must implement SMK3 and undergo periodic audits.

Core employer obligations

  • Provide Personal Protective Equipment (PPE) appropriate to the work type and risk level.
  • Establish an Occupational Safety Committee (P2K3) for companies with 100 or more employees.
  • Report every workplace accident to the local Manpower Office within 48 hours.
  • Register all workers under BPJS Ketenagakerjaan's Workplace Accident Insurance (JKK) program.
  • Conduct periodic hazard identification and risk assessment.

K3 and BPJS Ketenagakerjaan JKK

The JKK program covers medical costs for work-related accidents and occupational diseases, plus temporary disability benefits. Contributions are borne entirely by the employer, ranging from 0.24% to 1.74% of wages depending on job risk category. Delayed accident reporting can complicate claims and create a compliance liability of its own.
